Recap of CA Cleanup Fund Task Force Meeting, 11-17-2009


Task Force Meeting...

  Suspended Claims – It looks like the wait for claim “un-suspensions” may be over (good news), but with a price (bad news)… today Allan Patton presented us with the cash flow analysis that the Fund has compiled (based on additional revenues anticipated from the passing of AB 1188) over the next 9 quarters of revenue. Allan’s email and presentation is attached and will be presented to the Board tomorrow. Fund Staff is in favor of releasing half of the claim suspensions, due to workload impacts of releasing all 1100 claims. Allan does not know exactly what the Board will decide tomorrow, but believes they will make a decision to release at least half of the suspensions. The Task Force voted unanimously to recommend to the Board tomorrow to Un-suspend all Priority C claims, effective January 1, 2010. BUT… if the Board concurs and lifts all suspensions, it means that the payment cycle for the Priority C claims will continue to be delayed from 9 – 18 months.

  Status of Payments – As of 11/16/09 – Anticipate $46M available from Oct 2009 Revenues. $5M has already been released from hold status and is in the process of being made with Oct revenues. When revenues are deposited into the Fund’s Account (as the BOE collects the tax payments in batches over a 2 -3 week period), the Fund releases payments to Accounting. Accounting has two weeks to process the payment and send it to the State Controller’s Office (SCO). The SCO also has 2 weeks for processing (to cut the check). The Fund has no control of the timeline once it goes to Accounting. When your claim is posted to the “Payments Released Against Quarterly Revenue” list on the website, you can anticipate payment within 2 – 4 weeks.

  School District Account - Effective immediately, LOC suspensions for all C & D School District Claims has been lifted. B , C & D Priority SDA RR’s are now paid out of one Account, named the School District Account (SDA) (no longer considered part of Priority D Class). See attached “Updates to School District Account”, issued by the USTCF.

  New Appeal Form – To standardize and streamline the Appeal process for previously denied costs in a RR, the Fund has developed a new form to be used for all new appeals. New form is attached and is also posted to the Fund website. Please start using it immediately. payment within 2 – 4 weeks.

  AB1188 – Signed into law 11/5/09. No additional details of this bill were discussed (other than already described).
