USTCF Task Force Final Report 


I am pleased to present to you the final report by the USTCF Task Force that will be delivered to the State Water Resources Control Board. I hope that you will find that the Task Force represented your interests and articulated them accordingly to the SWRCB. I can tell you that I tried my best to get your voices heard at the Task Force meetings as well as to USTCF staff and management.

It is my understanding that this report will be delivered now to Dorothy Rice and the SWRCB and will also be publically presented to the SWRCB as an “informational item” at the February 16, 2010 Board Meeting. If I find out anything to the contrary, I will let you know.

For those of you that don’t wish to read this document in its entirety, to recap for you, this report highlights the work of the Task Force since our first meeting in July 2009 through our last meeting on December 2, 2009 and includes 9 specific recommendations the Task Force would like the Board to direct/enforce with the USTCUF to help return it to its intended function – providing a stable and reliable reimbursement program to claimants

Beyond this report, the Task Force intends on meeting again after the independent Program Auditors report is presented. The current deliverable date of this report to the SWRCB is March 1, 2010. The Task Force is scheduled to meet next on March 10, 2010 to review the Auditor’s findings. Afterwards, future Task Force meetings will be made throughout 2010 as necessary. One of our recommendations is to appoint a 12 member advisory committee to act as an ongoing sounding board for USTCF management and staff. It is my intention to be a part of this group and continue my involvement with the USTCF as I have this past year.

I will continue to keep you posted on progress made by the USTCF. They are currently working on publishing “GUIDELINES for Carrying Cost Reimbursement” per the passage of AB1188. I was last told to expect the guidance within the next few weeks. Any B or C claimant that has received a “Hold Letter” or “No Payment Letter” since 11/08 will be eligible to claim reimbursement for any carrying/interest costs. This guidance will provide claimants and other stakeholders with the details needed to know who qualifies and what documentation is required. Please note that AB1188 only allows for such charges to be reimbursable through June 30, 2010.
